The Supreme Court is set to decide on Monday whether President Bola Tinubu should be removed from office, following a fresh lawsuit that challenges his eligibility to hold the position and alleges he usurped the office in violation of Nigerian law, SAVANNAH NEWSNOW REPORTS
The lawsuit, filed by Chief Ambrose Albert Owuru, a candidate in the 2019 presidential election, lists former President Muhammadu Buhari, the Attorney General of the Federation and Minister of Justice, the Independent National Electoral Commission, and Tinubu as defendants.
Owuru, a British-trained lawyer who was called to the Nigerian Bar in 1982, maintains that he won the 2019 presidential election, but his tenure was allegedly hijacked by Buhari for eight years.
He claims that his Supreme Court case, which would have removed Buhari from office, was technically dismissed due to a mix-up in the hearing dates.
Owuru is now asking the Supreme Court to disqualify Tinubu, citing his alleged involvement in drug trafficking and forfeiture of $460,000 to the United States.
He also accuses Tinubu of being a CIA agent, which he claims makes him ineligible to hold the office of President.
Owuru is seeking a Supreme Court declaration that he is the rightful President of Nigeria and an order for his immediate inauguration to reclaim his allegedly usurped mandate.
Meanwhile the apex court has fixed Monday, December 16, for definite hearing into the suit.
The hearing notice in respect of the new suit reads: “Please kindly take note that SC/CV/667/2023 Chief Ambrose Albert Owuru & Anor VS President Muhammadu Buhari & 3 Ors at the Supreme Court of Nigeria sitting at Abuja is slated for the hearing of Motions on Monday 16/12/2024.
“Thanks, Ukor Michael Akan, for: the Hon. Chief Registrar.”
Report revealed that Tinubu has been served with the hearing notice through the Office of the Attorney General of the Federation and Minster of Justice.
It was gathered that Chief Wole Olanipekun, SAN, may defend Tinubu in the suit on Monday.
